  1. GENERAL PROVISIONS

These Regulations are addressed to individual Clients - Consumers. The provisions of these Regulations are not intended to exclude or limit any consumer rights conferred on them by mandatory provisions of law - any possible doubts are explained in favor of the consumer. In the event of non-compliance of the provisions of these Regulations with the above provisions, these provisions shall prevail.

The administrator of personal data processed in connection with the implementation of the provisions of these Regulations is the Service Provider. Personal data is processed for the purposes, to the extent and based on the principles set out in the company's privacy policy. Providing personal information is voluntary. Each person whose personal data is processed by the Service Provider has the right to inspect their content and the right to update and correct them.

Definitions:
WORKING DAY - one day from Monday to Friday, excluding public holidays
REGISTRATION FORM - a form available in the Online Store that allows you to create an individual Customer Account.
ORDER FORM - Electronic Service, an interactive form available in the Online Store that allows you to place an order,
  in particular by adding products to the electronic basket and defining the terms of the sales contract, including the method of delivery and payment.
CUSTOMER - a customer who intends to conclude or has concluded a sales contract with the seller.
CIVIL CODE - the Civil Code Act of April 23, 1964.

and the password provided by the service recipient a set of resources in the service provider's IT system, in which the Customer's data is collected, including information about placed orders.
PRODUCT - a movable item available in the Online Store which is the subject of a sales contract between the customer and the seller.
REGULATIONS - these regulations of the Online Store.
ONLINE STORE - the service provider's online store available at the internet address:www.babygroup.plSELLER - Edward Czyż running a business under the name PPHU WITPOL II, ul. SALES AGREEMENT - a product sale agreement concluded or concluded between the customer and the seller via the online store.
ELECTRONIC SERVICE - a service provided electronically by the service provider to the recipient via the Online Store.
SERVICE RECIPIENT - a natural person with full legal capacity, and in cases provided for by generally applicable regulations also a natural person with limited legal capacity; a legal person or an organizational unit without legal personality, which the law grants legal capacity to use the electronic service.
ORDER - the customer's declaration of intent submitted via the order form and aimed directly at concluding a product sale agreement with the seller.

2. ELECTRONIC SERVICES IN THE ONLINE STORE

The following electronic services are available in the Online Store: Customer Account and Order Form. Account - using the Account is possible after completing the registration form and clicking the "Register" field. In the registration form, it is necessary to provide the following data of the Service Recipient: e-mail address and password. Order Form - the use of the order form begins when the first product is added to the electronic basket in the online store. Placing an order takes place after completing the order form and clicking the "Buy" field - until then it is possible to modify the entered data (to do this, follow the displayed messages and information available on the Online Store website). In the order form, it is necessary to provide the following data: name and surname / company name, address (street, house / flat number, zip code, city, province, country), e-mail address, contact telephone number, product / s, quantity of product / s , place and method of delivery, method of payment.

The use of electronic services by the Customer is free of charge. The account in the Online Store is provided for an indefinite period. The use of the order form is one-off and ends when the order is placed through it. Another order requires opening another form.

Technical requirements necessary for cooperation with the ICT system used by the Service Provider:

A computer or other multimedia device with Internet access

Access to e-mail

Web browser

Enabling cookies and Javascript support in the web browser. The Service Recipient is obliged to use the Online Store in a manner consistent with the law and morality, with respect for personal rights and intellectual property rights of third parties.

The Service Recipient is obliged to enter data in accordance with the facts.

The Service Recipient is prohibited from providing illegal content.

3. CONDITIONS FOR CONCLUDING A SALES AGREEMENT.

Announcements, price lists and other information about the Products provided on the websites of the Online Store, in particular their descriptions, technical and functional parameters and prices, constitute an invitation to conclude a contract, within the meaning of art. 71 of the Civil Code of Polish law.

The final price of the Product shown on the Online Store website is given in Polish zlotys and includes all components, including VAT. The prices, however, do not include any possible delivery costs, which are indicated when placing the Order.

The price of the Product shown on the website of the Online Store is binding at the time of placing the order by the customer. This price will not change regardless of price changes in the Online Store, which may occur for individual products after the customer places an order.

Conclusion of a sales contract using the order form. In order to conclude a sales contract, it is necessary for the customer to place an order in advance. After placing the order, the seller immediately confirms its receipt, which binds the customer with his order and at the same time accepts the order for execution. Confirmation of receipt of the order and its acceptance for execution takes place by sending an appropriate message to the customer's e-mail address provided during the ordering process, which contains at least confirmation of all essential elements of the order, the seller's statement on receipt of the order and its acceptance for execution. As soon as the customer receives the e-mail referred to in the sentence above, a sales contract is concluded between the customer and the seller.

Consolidating, securing and making the content of the concluded sales contract available to the customer takes place by making these Regulations available on the website of the online store and sending the customer the e-mail message referred to in point 3.4., As well as by attaching the proof of purchase to the parcels. The content of the Sales Agreement is additionally recorded and secured in the IT system of the seller's Online Store.

4. METHODS OF PAYMENT

The Seller provides the following payment methods and the final choice of payment method is agreed with the Customer when accepting the order:

Payment to the courier for cash on delivery

Prepayment to a bank account - payment by traditional transfer to the seller's bank account.

5. COST, TIME AND METHODS OF SHIPMENT

The Seller provides the following methods of delivery or collection of the Product: Delivery by courier, Shipment by Polish Post.

The cost of delivery is: PLN 25 - Courier shipment in Poland, the price of shipment by Poczta Polska according to the price list of Poczta Polska.

The deadline for shipping the product to the customer is from 3 to 5 business days, after the payment is credited to the account.

The cost of delivery by a courier company applies to an order in a collective packaging with a maximum dimensions of 47x82x45 cm and a maximum weight of 30 kg.

 

6. COMPLAINT PROCEDURE

Complaints for non-compliance of the product with the sales contract:
The basis and scope of the seller's liability to the customer who is a natural person, who purchases the product for purposes not related to professional or business activity, for non-compliance of the product with the sales contract, are defined in particular by the Act on specific terms of consumer sales and amending the Civil Code of July 27, 2002 r. (Journal of Laws No. 141, item 1176 as amended).
Notifications about the non-compliance of the product with the sales contract and the submission of a relevant request can be made via e-mail to the following address: kerttusklep@gmail.com The seller will respond to the customer's request immediately, no later than within 14 days.
The response to the complaint is sent to the address provided by the customer, unless the customer specifies a different method.
In the case of products covered by the guarantee, the seller informs that the guarantee for the sold consumer goods does not exclude, limit or suspend the rights of the buyer resulting from the non-compliance of the goods with the contract.
Products in the online store www.babygroup.pl are covered by the warranty of the manufacturers of goods for up to 1 year. The method of considering the warranty repair of products is each time considered individually by the manufacturer of the goods.

Complaints related to the operation of the Online Store:
Complaints about goods related to products purchased in the Online Store www.babygroup.pl may be submitted by the service recipient via e-mail to the following address: kerttusklep@gmail.com or in writing to the company's address. This way will be the agreed method of possible collection of the advertised product from the Customer and delivery of it to the Customer after repair. The claimed product must be delivered to the place of collection in a packaging ensuring safe transport and legibly described with the Buyer's data
It is recommended to provide in the description of the complaint as much information and circumstances as possible regarding the subject of the complaint, in particular the type and date of the occurrence of the irregularity, description of the damage, proof of purchase and contact details - this will facilitate and speed up the consideration of the complaint.
The service provider's response to the complaint is sent to the address provided by the recipient, unless the recipient specifies otherwise.

7. RIGHT TO WITHDRAW FROM THE CONTRACT

The Service Recipient / Customer who is also a consumer who has concluded a distance contract may withdraw from it without giving reasons by submitting an appropriate statement in writing within 14 days from the conclusion of the contract or receipt of the goods. To meet this deadline, it is enough to send a statement before its expiry. The statement should be sent to the e-mail address kerttusklep@gmail.com or in writing to the address ul. Kaszubska 11, 42-200 Częstochowa. We do not accept product returns and refunds beyond 15 days from purchase.

In the event of withdrawal from the contract, the contract is considered void.

The consumer returns the items that are the subject of the contract from which he withdrew, at his own expense and to the following address: Baby Group, ul. Kaszubska 11, 42-200 Częstochowa; Poland, or to another address indicated by the seller.

The consumer returns the goods as part of the withdrawal from the contract, intact, with no signs of use. In the event of a decrease in the value of the item, the customer is responsible for the reduction of the item being the subject of the contract as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the item. The manufacturer shall assess whether the value of the item has diminished.

The Seller shall immediately, no later than within 14 days from the date of receipt of the returned goods, return to the Consumer all payments made by him, including the costs of delivering the goods, and if the Consumer has chosen a delivery method other than the cheapest standard delivery method offered by the Seller, the Seller will not refund the Consumer these additional costs, in accordance with Article 33 of the Consumer Law.

The seller withholds the reimbursement of the payment received from the consumer until the item is returned or the consumer provides proof of its return, depending on which event occurs first, until it is assessed whether the items returned intact.
The seller shall refund the payment for the goods, less any costs.

The Seller shall refund the payment to the bank account, unless the consumer has expressly agreed to a different payment method that does not involve any additional costs for the Seller.

The right to withdraw from the contract does not apply to a contract in which the subject of the service is an item manufactured according to the customer's specification or serving to satisfy his individual needs (special order).

8. FINAL PROVISIONS

Agreements concluded via the Online Store are concluded in accordance with Polish law and the regulations of the European Union.

Changing the Regulations:
The Service Provider reserves the right to amend the Regulations for important reasons, i.e. changes in the law; changes in payment and delivery methods; changes in the scope, payment or form of the services provided, changes to the address of the Seller - to the extent to which these changes affect the implementation of the provisions of these Regulations. The amended regulations bind the Service User if the requirements specified in art. 384 of the Civil Code, ie the Service Recipient has been properly informed about the changes and the Service Recipient has not terminated the contract for the provision of Electronic Services of a continuous nature within 14 days from the date of notification.
Amendments to the Regulations will not in any way infringe the acquired rights of Service Users who are both consumers and using the Online Store before the amendments come into force, in particular amendments to the Regulations will not affect already placed or placed Orders and concluded, implemented or performed Sales Agreements.
In the event that the amendment to the Regulations results in the introduction of any new fees or an increase in existing fees, the Service Recipient who is a consumer has the right to withdraw from the contract.

In matters not covered by these Regulations, the provisions of the Civil Code shall apply; Act on the provision of electronic services of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended); Act on the protection of certain consumer rights and liability for damage caused by a dangerous product of March 2, 2000 (Journal of Laws No. 22, item 271, as amended); The Act on special conditions of consumer sales and amending the Civil Code of 27 July 2002 (Journal of Laws No. 141, item 1176, as amended) and other relevant provisions of Polish law.

Disputes arising between the Service Provider / Seller and the Consumer shall be submitted to the competent common courts of the place of business by the Service Provider.

The Service Recipient / Customer may use extrajudicial means of dealing with complaints and redress.
